1. Who We Are

These Terms govern your use of the website and any related landing pages operated by Camber Flow (the “Company,” “Camber Flow,” “we,” “us,” or “our”), a registered partnership based in the Province of Ontario, Canada. We specialize in providing digital marketing solutions for automotive remodeling businesses across Canada and the United States, including lead generation, paid advertising, and conversion optimization.

Note: Our website is informational and lead-generation only. Any paid services are provided under a separate written agreement.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.

2. Acceptance of Terms
By accessing or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. If you do not agree, do not use this site.

We may update these Terms from time to time without prior notice. Your continued use of the site after changes are posted constitutes your acceptance of the revised Terms.

3. Scope of the Site & Services

Our website allows businesses to learn about our services and submit inquiries. You may also express interest in city or territory exclusively. Exclusivity is not granted unless and until it is explicitly provided in a separate signed agreement, any required deposits or fees are paid, and all conditions such as performance, spending, inventory of service capacity, and geographic definitions specified in that agreement are met.

Submitting an inquiry does not guarantee acceptance as a client or exclusive rights. You agree to provide accurate and complete information when submitting any inquiry or request.

Camber Flow is under no obligation to provide services until a separate written agreement is executed. We reserve the right to decline any inquiry or request at our sole discretion.

No user accounts, software downloads, or on-site purchases are offered. Any commercial relationship (scope, fees, deliverables) is governed exclusively by the separate written agreement.

4. Eligibility; Age

By using this site, you represent and warrant that you are at least 18 years of age and have the legal authority to enter into these Terms. If you are accessing or using the site on behalf of a business or other entity, you further represent and warrant that you have full authority to bind that entity to these Terms.

5. Limited License

We grant you a limited, revocable, non-exclusive, non-transferable license to access and view this site solely for the purpose of evaluating our services or submitting an inquiry. All other rights are expressly reserved.

You may not copy, reproduce, modify, distribute, transmit, display, perform, publish, license, create derivative works from, or otherwise exploit any content on this site without our prior written consent. Any unauthorized use of the site or its content may violate copyright, trademark, and other applicable laws.

6. Intellectual Property

Camber Flow™, along with all associated logos, designs, trade dress, and branding elements, are trademarks or trade names of Camber Flow (partnership), whether registered or unregistered. All content on the site, including text, graphics, images, and layout, is protected by intellectual property laws.

No rights are granted by implication, estoppel, or otherwise. Any goodwill arises from permitted use of our trademarks or branding inures exclusively to Camber Flow. Unauthorized use of our intellectual property is strictly prohibited and may result in legal action.

7. Acceptable Use

You agree not to engage in any activity that could harm or interfere with the proper functioning of the site or violate applicable laws. Specifically, you agree not to:
(a) scrape, harvest, or collect data from the site without authorization;
(b) probe, scan, or test the vulnerability of the site or its networks;
(c) interfere with or disrupt the site or its servers, including introducing viruses, malware, or harmful code;
(d) reverse engineer, decompile, or attempt to extract source code from any portion of the site;
(e) send spam, unsolicited communications, or unauthorized messages;
(f) impersonate any person or entity or misrepresent your affiliation;
(g) use the site for any unlawful, fraudulent, or prohibited purpose.

Violation of these terms may result in suspension or termination of your access and may expose you to legal liability.

8. Third-Party Services & Links/Limited Sharing with Service Providers

We may share your information with trusted service providers who assist us in operating our website, delivering services, processing payments, or supporting communications. These providers are bound by contractual obligations to:
- Use the information only as instructed by us
- Maintain confidentiality and implement appropriate security measures
- Comply with applicable privacy laws

Typical service providers include:
1. Payment processors (e.g., Stripe, PayPal, Intuit) – solely for processing your payments
2. Email service providers – solely for sending communications you have opted into
3. Website hosting services – solely for hosting our website and its content
4. Message aggregators and SMS platforms – solely for delivering text messages you have opted into receiving
5. CRM platforms – for client relationship management

Special Note on SMS Data: Your mobile number and SMS consent data will not be shared with third parties for marketing or promotional purposes. It will only be used by aggregators, necessary to deliver the SMS service.

Our site may reference or integrate third-party platforms and tools (e.g., Google Ads, Meta, Go High Level, telephony, or call-tracking providers). These third-party services are subject to their own terms and privacy policies, which you should review carefully.

We do not control, endorse, or assume responsibility for third-party sites, tools, or services. Your use of any third-party service is at your own risk, and Camber Flow disclaims all liability arising from such use.

9. Communications; Call Recording; Automated Assistant

By providing your contact details or initiating contact with us, you consent—where permitted by law—to receive communications from Camber Flow via email and, if you opt in, via phone or SMS.

Calls may be monitored or recorded where required or permitted by law, and any legally required consent or notice will be provided. If you do not consent to recorded calls, please contact us by email at [email protected].

We may use automated assistants (e.g., chatbots or IVR systems) for scheduling and FAQs. Where mentioned, any “ringless voicemail” or similar technology will be used only when permitted by law and with any required consents or notices.

You may opt out of such outreach at any time using the methods described in Section 16 (SMS/MMS Program Terms) or by emailing [email protected]. Please also review our Privacy Policy for details on how we handle your data.

10. Payments, Fees, and Refunds

We do not collect payments through this site. If you engage Camber Flow for services, payment will be handled separately—such as via invoice or secure payment link through Stripe or Wise—under a separate written service agreement. That agreement will specify fees, any retainers, refund or cancellation terms, and billing schedules.

If you believe you were billed in error, please contact us at [email protected] so we can investigate. We may contest improper chargebacks in accordance with applicable law and card-network rules.

11. No Guarantees Unless in a Signed Contract

We make no binding guarantees via this site. Any performance guarantee (for example, a specific number of leads within a timeframe) is enforceable only if expressly stated in a separate written contract signed by both parties.

12. Disclaimers

THE SITE AND ALL CONTENT MADE AVAILABLE THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES—EXPRESS, IMPLIED, OR STATUTORY—INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

13. Limitation of Liability (Site Use)

TO THE FULLEST EXTENT PERMITTED BY LAW, CAMBER FLOW (PARTNERSHIP) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO YOUR USE OF THE SITE IS CAPPED AT $500 (FIVE HUNDRED DOLLARS).

Some jurisdictions do not allow certain exclusions or limitations, so some terms may not apply to you. These limits do not apply to liabilities that cannot be limited by law, nor to our intentional misconduct or fraud. For paid services, liability (if any) will be governed by the separate service agreement.

14. Indemnification

You agree to defend, indemnify, and hold harmless Camber Flow and its partners, officers, directors, employees, and agents from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
(a) any content or information you submit to us;
(b) your use of the site in violation of these Terms or applicable law; or
(c) your breach of any representation or warranty herein;
except to the extent caused by our gross negligence or willful misconduct.
We may assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate fully at our request. These obligations survive termination of these Terms.

15. Dispute Resolution

Governing Law & Venue: These Terms and any dispute related to the site are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-law principles. The exclusive venue for any such dispute is the provincial or federal courts located in Ontario (including Vaughan/Toronto).
No Arbitration: Unless otherwise agreed in a signed contract, disputes will be resolved in court.
Individual Actions Only; Jury Waiver: To the extent permitted by law, the parties waive class or representative actions and waive the right to a jury trial (bench trial only). Nothing herein limits non-waivable consumer rights under applicable U.S. or Canadian law.
Injunctive Relief: We may seek injunctive or equitable relief in any court of competent jurisdiction to protect our intellectual property or confidential information.
Severability: If any provision of this section is found unenforceable, the remaining provisions will remain in full force and effect.

16. SMS/MMS Program Terms (If You opt in)

Program Name: Camber Flow SMS — Scheduling & Updates
Sender: Camber Flow via a number capable of SMS/MMS (and possibly voice).
Purpose: Scheduling, reminders/confirmations, territory/exclusivity status updates (if applicable), follow-ups, and service-related support.

Opt-In: By submitting your phone number and clicking “Submit,” or by texting us first, you expressly consent to receive SMS/MMS messages from Camber Flow for the purposes described above. Consent is not a condition of purchase.

Frequency: Message frequency may vary based on engagement; typically, a handful of messages during active scheduling/onboarding, then fewer thereafter.

Opt-Out: Reply STOP (or END/CANCEL/UNSUBSCRIBE/QUIT) to end texts. A final confirmation may follow.
Help: Reply HELP for help, or email [email protected].

Rates/Delivery: Message and data rates may apply. Delivery depends on your carrier; carriers are not liable for delayed or undelivered messages. We are not responsible for delays or failures caused by carriers or technical issues.

Calls/Voicemail: Where permitted by law and with any required consent, you may receive occasional automated or prerecorded calls and/or ringless voicemails limited to the purposes above. You may opt out at any time via STOP or by emailing [email protected].

Quiet Hours: We aim to contact you between 8:00 a.m.–8:00 p.m. your local time, unless you request otherwise. We limit outreach attempts (generally no more than 3 contact attempts per 24-hour period across texts/calls).

Records & Privacy: We keep records of your consent and STOP/HELP requests as required by telecom rules. Personal information is handled by our separate Privacy Policy and will not be sold or shared except as required for service delivery.

Compliance: We comply with applicable laws, including the Telephone Consumer Protection Act (TCPA) in the U.S. and Canada’s Anti-Spam Legislation (CASL).

A2P Compliance: We adhere to carrier A2P verification requirements and maintain records of consent for compliance audits.

Data Handling: Your mobile number will never be sold or shared for marketing purposes. It is used only for service-related communications as described in our Privacy Policy.

Legal Compliance: All messaging practices comply with TCPA (U.S.) and CASL (Canada), including opt-in, opt-out, and consent record-keeping.

17. Electronic Communications

By using the site or providing your email address, you consent to receive communications from us electronically. You agree that such communications, including notices, disclosures, and agreements, may satisfy any legal requirement that such communications be in writing.
We may provide notices by posting them on the site or by emailing you at the address you provide. You are responsible for keeping your contact information current. For official notices to us, email [email protected].

18. Privacy

Our Privacy Policy (published separately) explains how we collect, use, disclose, and protect personal information and your choices. It is incorporated by reference into these Terms.

19. Use of Client Name/Logo & Testimonials (For Paying Clients)

If you become a client, you grant us permission to identify you as a client (e.g., display your name or logo on our website or in presentations) and to use any testimonial or review you voluntarily provide, solely for marketing and promotional purposes.
You may opt out of such use at any time by notifying us in writing. We will not disclose confidential strategy, budgets, or other sensitive information without your consent, except in aggregate or anonymized form.

20. Changes to These Terms

We may modify these Terms from time to time. The Effective Date will show the latest revision. If changes are material and we have an ongoing relationship with you, we may notify you by site notice or email. Your continued use of the site after changes means you accept the updated Terms.

21. Miscellaneous

Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, power outages, war, terrorism, labor actions, governmental acts, pandemics, or cyberattacks.
Assignment: You may not assign these Terms without our prior written consent; any attempt to do so is void. Camber Flow may assign these Terms as part of a merger, acquisition, or sale of assets or business.
Severability: If any provision of these Terms is found invalid or unenforceable, it will be interpreted to achieve the original intent or deemed severed, and the remaining provisions will remain in full force and effect.
Waiver: A failure to enforce any provision is not a waiver of that provision. Waivers must be in writing and signed by the party granting them.
Entire Agreement: These Terms (and any incorporated documents, including our Privacy Policy) constitute the entire agreement regarding site use and supersede all prior communications related to site use.
Survival: Provisions relating to intellectual property, indemnification, disclaimers, limitation of liability, and dispute resolution survive termination of these Terms.
